BGH: No compulsory treatment without trying to convince

Convincing a mentally ill patient to agree to medical treatment is only possible without pressure. The compulsory medical treatment can only be approved later, if the doctors attempting to convince them, “seriously, with the necessary time and without exerting undue pressure”, the Federal Court of Justice (BGH) in Karlsruhe decided on Thursday, October 18, 2018, published decision (Az .: XII ZB 87/18).

According to these standards, a woman from Hanover failed in the specific case, who could not recognize her existing physical illnesses due to her chronic paranoid disorder. Therefore, she also refused to take the necessary anticoagulant medication to prevent atrial fibrillation.

The Hanover District Court ordered placement in the psychiatric ward and, after obtaining an opinion, approved the compulsory treatment. Otherwise there is an "immediate vital self-endangerment".

Her complaint against this had no success before the BGH. Compulsory treatment is only allowed if doctors have previously tried to persuade the patient to agree to the therapy. This must be done seriously, with the necessary time and without pressure. However, the treating doctors complied with this.

The district court had very briefly pointed out that the woman refuses the necessary treatment "despite sufficient attempts at voluntary medication". However, the court had previously obtained a statement from the clinic on how the treating doctors tried to convince the woman to take the necessary medication on a voluntary basis.
